These Terms of Use ("Terms") govern your access to and use of the Surely website (surelyhealth.in) and the Surely / InstaCare mobile app (together, the "Service"), operated by Aartas Care Private Limited ("ACPL", "Surely", "we", "us"). By accessing the Service or booking a care visit, you agree to these Terms and to our Privacy Policy.
1. Eligibility
You must be at least 18 years old, and located within a serviceable area, to book a visit through Surely.
2. The service
Surely connects you with qualified nurses and doctors who can visit your home for nursing care, first aid, and treatment of everyday illness. Surely operates the booking and dispatch platform — care itself is provided by the assigned medical professional, subject to their own professional judgment.
3. Not for emergencies
Surely is not an emergency medical service. If you or someone with you is experiencing a life-threatening emergency, call your local emergency number or go to the nearest hospital immediately — do not rely on Surely for emergency care.
4. Booking, payment and cancellation
- A booking is confirmed once payment is completed through the app.
- You may cancel a booking within the cancellation window shown at the time of booking; cancellation fees may apply after that window.
- Refunds, where applicable, are processed to your original payment method as described in the app at the time of booking.
5. Your responsibilities
- Provide an accurate address, contact details, and any health-related information necessary for safe care.
- Ensure a safe, accessible environment for the visiting professional.
- Treat the visiting doctor or nurse with respect — abusive behavior may result in suspension of your account.
6. Use of the website and app
You agree not to:
- Use the Service for any unlawful purpose
- Copy, modify, or reverse-engineer any part of the Service
- Interfere with the security or proper functioning of the Service
7. Intellectual property
All content on the Surely website and app — including text, graphics, logos and software — is owned by or licensed to ACPL and may not be used without permission.
8. Limitation of liability
To the maximum extent permitted by law, ACPL is not liable for indirect, incidental, or consequential damages arising from your use of the Service. Nothing in these Terms limits any liability that cannot be excluded under applicable law.
9. Termination
We may suspend or terminate your access to the Service if you violate these Terms.
10. Governing law
These Terms are governed by the laws of India, and any disputes shall be subject to the exclusive jurisdiction of the courts in New Delhi.
11. Changes to these terms
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
